Terms and Conditions for Ordering and Delivery of Cakes
1. Orders and Payments
1.1 All cake orders must be confirmed and paid in full prior to preparation and delivery.
1.2 Once an order is placed and confirmed, it cannot be cancelled or refunded due to the
perishable and customised nature of our products.
2. Returns, Refunds, and Consumer Guarantees
2.1 Due to health and safety regulations, we do not accept returns of cakes or other
perishable food products.
2.2 Under Australian Consumer Law, customers are entitled to a replacement or refund if
the product is faulty, not as described, or does not meet consumer guarantees. This applies
only where a genuine fault is proven and does not cover change of mind, incorrect choice, or
damage caused after delivery.
3. Delivery and Collection
3.1 Delivery is available to agreed addresses and times arranged at the point of order.
3.2 If a customer elects to have their order delivered, the cake will be considered delivered
once it has been handed to the customer, their representative, or left in a location
nominated by the customer.
3.3 Risk and responsibility for the cake pass to the customer once delivery is completed. We
are not liable for any loss, damage, or deterioration occurring after delivery or collection.
4. Quality and Handling After Delivery
4.1 All cakes are prepared and delivered in good faith, with quality checks prior to release.
4.2 Once delivered, it is the customer’s responsibility to handle, store, and consume the cake
appropriately (e.g., refrigeration, avoiding heat/sunlight).
4.3 We do not accept liability for damage, spoilage, or deterioration of products after
delivery or collection.
5. Limitation of Liability
5.1 To the maximum extent permitted by law, we are not liable for any indirect, incidental,
or consequential loss or damage resulting from the supply of our products.
5.2 Nothing in these Terms & Conditions excludes or limits any rights or remedies you may
have under the Australian Consumer Law.
6. Agreement

By placing an order with us, you acknowledge and agree to these Terms & Returns.
